On July 13, 1953, a collision occurred between a truck operated by the plaintiff and an automobile driven by the defendant Yerkes. Plaintiff's vehicle was proceeding east on Highway 30 about one mile west of the junction of Highways 30 and 14, in Marshall County. The defendant was going west, following a truck driven by the proposed third-party defendant, Cross. For the sake of brevity and to avoid confusion, the plaintiff will hereinafter be referred to as Best; the defendant as Yerkes; and the third-party defendant as Cross.
